By accessing or using Lundra (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service
Lundra is a daily well-being check-in application designed to help families stay connected with vulnerable loved ones. The Service allows:
- Caregivers to create accounts and invite family members
- Invited members (parents/loved ones) to share their daily well-being status ("I'm okay" or "Not okay")
- Caregivers to monitor the well-being status of their invited members through a dashboard
3. Important Disclaimer
Lundra is NOT a medical device, emergency service, or substitute for professional healthcare.
The Service is designed for non-medical, social well-being check-ins only. It should not be used for:
- Medical monitoring or diagnosis
- Emergency response or alerts
- Replacing professional caregiving services
- Health tracking or medical purposes
In case of emergency, please contact local emergency services immediately.
4. Account Registration
To use the Service as a caregiver, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
5. Subscription and Payment
5.1 Free Trial
New users are eligible for a 7-day free trial. No payment is required during the trial period.
5.2 Subscription Fees
After the free trial, continued use of the Service requires a paid subscription of $5 CAD per month. All payments are processed securely through Stripe.
5.3 Automatic Renewal
Subscriptions automatically renew each month until cancelled. You will be charged on the same date each month.
5.4 Cancellation
You may cancel your subscription at any time through your account dashboard. Upon cancellation:
- You will retain access until the end of your current billing period
- No refunds will be issued for partial months
- Your account data will remain available until you request deletion
5.5 Refund Policy
All sales are final. We do not offer refunds for subscription fees. You may cancel at any time to prevent future charges.
6. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service
- Use the Service to harass, abuse, or harm others
- Share account credentials with unauthorized users
- Use automated systems to access the Service without permission
7. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Lundra and are protected by copyright, trademark, and other intellectual property laws.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
- WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS
We are not responsible for any harm resulting from your reliance on the Service for well-being monitoring. The Service is not a substitute for direct personal contact or professional care.
10. Indemnification
You agree to indemnify and hold harmless Lundra, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may suspend or terminate the Service for maintenance, updates, or other reasons without prior notice.
12. Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Non-payment of subscription fees
- Fraudulent or illegal activity
- Any other reason at our sole discretion
13. Governing Law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Quebec.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Effective Date." Continued use of the Service after changes constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
